1. Acceptance of Terms

By accessing and using Fantasma ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Fantasma is a visual builder that allows users to create and customize Ghost themes. The visual design is inspired by Ghost's Source theme, but all code is uniquely developed by Fantasma. The Service provides tools to design, configure, download, and publish production-ready Ghost themes.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

4. Free and Pro Tiers

Fantasma operates on a freemium model:

  • Free Tier: Provides access to sections that replicate the visual design of Ghost's official Source theme
  • Pro Tier: Provides access to additional sections and features beyond the free tier through a paid subscription

Current plan limits and Pro features are shown in the Service and on the pricing page.

5. Subscriptions and Billing

Fantasma Pro is billed as a recurring subscription. Checkout, payment processing, receipts, invoices, payment method updates, and subscription management are handled by our payment processor, Polar. By purchasing Pro, you authorize recurring charges according to the price, billing period, taxes, and renewal terms shown at checkout.

Pro access follows your subscription status. If a payment fails, a subscription is cancelled, revoked, disputed, or otherwise ends, Pro access may be limited or removed. You can manage or cancel your subscription from the billing portal linked in your account menu.

6. Intellectual Property and Theme License

The themes you create using Fantasma are your property. However, the following restrictions apply:

  • No Resale: You may NOT sell, resell, rent, lease, or sublicense the theme itself as a standalone product or as part of a theme collection or marketplace (e.g., Ghost.org Marketplace, ThemeForest).
  • No Redistribution: You may NOT redistribute the theme source code to third parties as a template or stock item.
  • Client Work Allowed: You MAY use themes to build websites for clients, provided the theme files are transferred as part of the final website deliverable and not sold as a separate theme product.
  • Unlimited Sites: You can use the same theme across unlimited sites for your own use or client work.

Each theme you download or publish includes the full license text in the theme package.

Fantasma retains all rights to:

  • The Fantasma builder software and platform
  • All Pro sections and components
  • The Fantasma brand and trademarks

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purposes
  • Attempt to reverse engineer or copy the Fantasma platform
  • Redistribute Pro sections or components without authorization
  • Interfere with or disrupt the Service or servers
  • Violate any applicable laws or regulations

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We store your theme configurations and user data to provide the Service. For anonymous users, data is stored locally in your browser. We use Plausible Analytics to understand how visitors interact with our website.

9. Service Availability

We strive to maintain high availability but do not guarantee that the Service will be uninterrupted or error-free. We reserve the right to:

  • Modify or discontinue the Service with or without notice
  • Perform maintenance that may temporarily interrupt service
  • Implement usage limits or restrictions

10. Limitation of Liability

Fantasma is provided "as is" without warranties of any kind. We shall not be liable for any damages arising from:

  • Use or inability to use the Service
  • Loss of data or themes
  • Errors or bugs in downloaded or published themes
  • Third-party integrations or services

11. Refund Policy

We offer a generous free tier that allows you to test the Service before making any purchase. Once a Pro subscription or feature is purchased, all sales are final and non-refundable.

We encourage you to thoroughly explore the free tier and ensure the Service meets your needs before upgrading to Pro.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.
